CULT TEE — TERMS OF SERVICE

These Terms of Service govern your use of the Cult Tee website and your purchase of products from us.

The website and Cult Tee store are operated by MELISSA AVGENICOS, trading as Cult Tee, ABN 82884124908 (“Cult Tee”, “we”, “us” or “our”).

By visiting our website, creating an account or purchasing a product from us, you agree to these Terms of Service and any policies referred to in them.

1. Australian Consumer Law

Our products come with guarantees that cannot be excluded under the Australian Consumer Law.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot legally be excluded, restricted or modified.

If there is any inconsistency between these Terms and your rights under the Australian Consumer Law, your statutory rights will prevail.

2. Online Store Eligibility

By using our website or placing an order, you confirm that:

• you are at least 18 years old, or have permission from a parent or legal guardian;
• the information you provide is accurate and complete;
• you are authorised to use the selected payment method; and
• you will not use our website or products for an unlawful purpose.

We may refuse service, cancel an order or restrict access to the website where reasonably necessary, including in cases of suspected fraud, misuse, pricing errors or a breach of these Terms.

3. Product Information

We make reasonable efforts to present our products accurately, including their colours, artwork, materials, dimensions and fit.

Colours may appear differently depending on your screen, device settings, garment colour, printing process and production location. Minor variations in colour, print placement, scale and finish may occur between products.

These minor production variations are not automatically considered defects. This does not limit your rights where a product fails to meet a consumer guarantee under the Australian Consumer Law.

Customers should review the product description, sizing information and care instructions before ordering.

4. Print-on-Demand Products

Some Cult Tee products are produced after an order is placed.

Because products may be printed individually and at different production facilities:

• minor variations may occur between production batches;
• production time is additional to shipping time;
• products within the same order may arrive separately; and
• packaging may vary depending on the production partner and destination.

These conditions do not affect your rights regarding faulty, damaged, incorrectly supplied or materially misdescribed products.

5. Orders

Submitting an order is an offer to purchase products from us. An order is accepted when we confirm acceptance or begin production or fulfilment.

An automated order confirmation only confirms that we have received your order. It does not guarantee acceptance.

We may cancel or refuse an order where:

• a product is unavailable;
• incorrect pricing or product information was displayed;
• payment cannot be authorised;
• shipping is unavailable to the supplied address;
• we reasonably suspect fraud, resale activity or misuse of a promotion; or
• accepting the order would breach a law or regulatory requirement.

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled portion.

6. Order Changes and Cancellations

Because many products enter production shortly after an order is placed, we cannot guarantee that an order can be changed or cancelled.

Customers should contact us immediately at support@culttee.com.au if an address, size, colour or product has been entered incorrectly.

If production or fulfilment has already begun, we may be unable to change or cancel the order. This does not affect any rights available under the Australian Consumer Law.

7. Prices and Payment

Unless otherwise stated:

• prices are displayed in Australian dollars;
• Australian prices include GST where applicable; and
• shipping charges are shown at checkout before payment.

International customers may be responsible for customs duties, taxes, import charges or handling fees imposed by the destination country. These charges are not controlled by Cult Tee and are generally not included in the purchase price unless expressly stated at checkout.

We may change product prices at any time. A price change will not affect an order that we have already accepted, except where an obvious pricing error has occurred.

8. Promotions and Discount Codes

Promotional offers are subject to the conditions displayed with the offer.

Unless otherwise stated:

• discount codes cannot be combined;
• discounts cannot be applied retrospectively;
• promotions have no cash value;
• offers are subject to product availability;
• minimum-spend requirements exclude shipping and gift cards; and
• promotions may be limited to one use per customer, household or order.

We may withdraw or correct a promotion where there has been an error, technical problem, fraud or misuse. We will not remove benefits from an order already accepted solely because a promotion later ends.

9. Limited Releases and Pre-orders

Limited-release products are available only while stocks or production capacity last.

A product being placed in a shopping cart does not reserve that product. Availability is confirmed only when the order is accepted.

Pre-order products may have estimated production or dispatch dates. These dates are estimates and may change due to manufacturing, supply or shipping delays.

If a material delay occurs, we will provide an update and any options required under applicable law.

10. Pre-orders and Limited Releases

Products identified as pre-orders are not ready for immediate dispatch. Any stated production or release date is an estimate and may change.

Unless otherwise stated, an order containing both pre-order and available products may be shipped together when all products are ready.

Limited-release products may be restricted by quantity, customer, household or delivery address. We may cancel orders that we reasonably believe are intended to circumvent these restrictions or facilitate unauthorised resale.

11. Care Instructions

Customers must follow the care instructions supplied with each garment.

Unless the individual product instructions state otherwise, we recommend washing printed garments inside out in cold water, using mild detergent, avoiding bleach and tumble drying, and not ironing directly over printed artwork.

Damage caused by care inconsistent with the supplied instructions may not constitute a product defect.

12. Website Accounts

If you create an account, you are responsible for maintaining the confidentiality of your login details and for activity conducted through your account.

You must notify us promptly if you believe your account has been accessed without authorisation.

We may suspend or close an account where it is used unlawfully, fraudulently or in breach of these Terms.

13. Intellectual Property

All Cult Tee artwork, illustrations, characters, product designs, photographs, videos, graphics, logos, trade marks, website content and written material are owned by or licensed to Cult Tee and are protected by applicable intellectual property laws.

Purchasing a product does not transfer ownership of the artwork or grant any right to reproduce, adapt, distribute, manufacture, sell or commercially exploit it.

You must not, without our prior written permission:

● copy or reproduce our artwork or website content;

● use our designs to manufacture other products;

● remove or alter branding, copyright notices or trade marks;

● use our content to train, develop or operate an artificial intelligence system or dataset;

● create derivative products from our artwork;

● scrape or systematically extract website content; or

● suggest that you are connected with or endorsed by Cult Tee.

You may share our publicly available social-media content for personal, non-commercial purposes where Cult Tee is clearly credited and the content is not altered in a misleading or harmful way.

14. Customer Content

If you tag Cult Tee, submit a review, enter a promotion or send us photographs, videos or other material, you retain ownership of your content.

Where you expressly permit us to repost or use that content, you grant Cult Tee a non-exclusive, worldwide, royalty-free licence to reproduce, display and share it for the agreed purpose.

You confirm that you own the content or have permission to provide it and that our authorised use will not infringe another person’s rights.

We will not use identifiable customer content in paid advertising without additional permission.

15. Reviews and Community Conduct

Reviews must reflect genuine experiences and must not contain unlawful, abusive, discriminatory, deceptive or infringing material.

We may moderate or remove content that breaches these requirements. We will not remove or suppress a genuine negative review merely because it is unfavourable.

16. Prohibited Use

You must not use our website:

● for an unlawful or fraudulent purpose;

● to infringe intellectual property or privacy rights;

● to transmit malicious code;

● to interfere with the website’s security or operation;

● to collect information about other users without authority;

● to impersonate another person;

● to submit false orders, chargebacks or claims; or

● to resell products commercially without our written approval.

17. Third-Party Services

Our website may rely on third-party providers for ecommerce hosting, payments, analytics, production, fulfilment and delivery.

Links to third-party websites are provided for convenience. We do not control their content and are not responsible for their separate practices, except to the extent required by law.

Your use of a third-party service may also be governed by that provider’s terms and privacy policy.

18. Website Availability

We aim to keep the website accurate, secure and available, but we do not guarantee uninterrupted or error-free access.

We may modify, suspend or discontinue any part of the website where reasonably necessary. This does not affect orders already accepted or rights that have already arisen.

19. Liability

Nothing in these Terms excludes, restricts or modifies any guarantee, right, remedy or liability that cannot lawfully be excluded, including rights under the Australian Consumer Law.

To the maximum extent permitted by law, Cult Tee is not liable for indirect or consequential loss that was not reasonably foreseeable, or for loss caused by:

● misuse of a product;

● failure to follow care instructions;

● inaccurate information supplied by the customer;

● unauthorised access resulting from the customer’s failure to protect account details; or

● events outside our reasonable control.

Any limitation of liability in these Terms applies only to the extent permitted by law.

20. Privacy and Marketing

Our collection, use and disclosure of personal information are described in our Privacy Policy.

Where required, we will obtain consent before sending electronic marketing. Marketing communications will identify Cult Tee and provide a functional way to unsubscribe.

Transactional messages concerning an order, payment, delivery, safety issue or account are not marketing messages.

21. Changes to These Terms

We may update these Terms to reflect changes to our business, website or legal obligations.

The version applying to an order is generally the version in effect when that order is placed, unless a change is required by law.

The latest version will be published on our website with its effective date.

22. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be read down or removed to the minimum extent necessary. The remaining provisions will continue to apply.

23. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

You and Cult Tee submit to the courts of New South Wales and any courts entitled to hear appeals from them. Nothing in this provision removes any right you may have to bring a consumer claim in another jurisdiction where applicable law allows it.
